You pull their file. They turned 65 six years ago. They never enrolled in Medicare Part B, assuming they could sign up later without consequence. What they didn't realize was that Medicare's penalty calculation is tied to the period they delayed enrollment, not the date they finally signed up.

This is one of the most misunderstood aspects of employer Medicare compliance: the financial consequence depends on how long someone went without the coverage they were expected to have. The clock often starts running earlier than people assume, and many employees don't realize there's an issue until they finally enroll and discover their premiums are permanently higher. How Medicare Penalties Actually Work

Medicare late enrollment penalties are generally not billed as a retroactive lump sum. Instead, they are ongoing premium surcharges calculated based on how long someone delayed enrollment after first becoming eligible.

For Medicare Part B, most people become eligible at age 65. If they do not enroll during their Initial Enrollment Period and do not qualify for a Special Enrollment Period through active employer coverage, they may face a penalty later when they enroll. The standard Part B penalty is 10% for each full 12-month period during which the individual could have had Part B but did not enroll. That higher premium generally lasts for as long as the person has Part B coverage.

Importantly, employees who are still actively working and covered under a qualifying employer group health plan can often delay Part B enrollment without penalty. However, they typically must provide proof of active employer coverage when they eventually enroll, commonly through CMS Form L564. Retiree coverage, COBRA coverage, and certain other types of coverage do not usually protect someone from the Part B late enrollment penalty.

The same concept applies to Medicare Part D prescription drug coverage. If someone goes without Part D or other creditable prescription drug coverage for 63 consecutive days or more after becoming eligible, they may owe a late enrollment penalty once they eventually enroll in Part D.

The Part D penalty is calculated as 1% of the national base beneficiary premium multiplied by the number of uncovered months. That amount is then added to the person's monthly Part D premium and may continue for as long as they maintain Part D coverage.

Why Part D Creates Employer Compliance Risk

Part D penalties can create additional challenges for employers because employers are responsible for notifying Medicare-eligible employees whether their prescription drug coverage is considered creditable under Medicare rules.

If an employer's drug coverage is creditable, employees may be able to delay enrolling in Part D without penalty. But employees can only make informed decisions if they receive proper notice explaining whether the coverage meets Medicare's creditable standard.

When employers fail to provide those notices, employees may unknowingly delay enrollment when they should not. The penalty itself is assessed against the employee, but the lack of proper notice can create compliance risk and employee relations issues for the employer. This is one of the most overlooked exposures in Medicare for employers, and it tends to surface only after a problem has already started.

These penalties are often preventable through timely education and clear communication. Employers managing benefits for Medicare-eligible employees should ensure employees understand:

Most Medicare penalty situations are not caused by intentional avoidance. They happen because employees misunderstand the rules, assume they can enroll later without consequences, or do not realize that certain types of coverage do not protect them from penalties. Employers who proactively educate employees before deadlines arrive can help prevent confusion, financial hardship, and unnecessary disputes later.

What Ohio Employers Should Know About Medicare Compliance

For Ohio Medicare-eligible employees, the same federal rules apply, but the practical pressure on employers is often heavier. Many Ohio employers have long-tenured workforces with employees aging into Medicare every year, and a single missed creditable coverage notice can create issues that ripple through HR, payroll, and benefits administration for years.

Ohio Medicare guidance is most useful when it is consistent, documented, and delivered before enrollment windows open. Employers who treat Medicare education as a recurring part of their benefits cycle tend to have far fewer penalty disputes than those who only address it when an employee raises a concern.
